1. Our Products and Services

AutoTrend System is an online charting and trading education platform for the US stock, forex, futures and cryptocurrency markets. Depending on your plan, the Products and Services include:

• the charting platform, with drawing tools, standard indicators, watchlists, chart layouts and alerts;
• our own indicators, add-ons and scanning tools;
• courses and lessons;
• the members dashboard, your account pages and the affiliate program.

What each plan and add-on includes is described on our website and in your account when you buy it. We keep improving the Products and Services and may add, change or remove features, as explained in section 13.

2. Who can use the Products and Services

You must be at least 18 years old and able to enter into a binding contract to use the Products and Services. You may not use them where the law that applies to you does not allow it. The Products and Services are for your own personal trading and learning: you may not use them to provide services to other people unless we agree to it in writing.

3. Your account

• Give us accurate information when you sign up and keep it up to date.
• Keep your password secret. You are responsible for everything done with your account. Tell us straight away at support@autotrendsystem.com if you think someone else has used it.
• An account is for one person only. You may not share your login, or sell, transfer or lend your account to anyone else.
• Your account can be logged in on a limited number of devices at the same time (currently 2). Logging in on a further device logs out the device with the oldest login.
• We may log you out, ask you to confirm who you are, or limit your account when we see signs of account sharing, unusual activity or misuse.

4. Plans, prices and payment

• Subscriptions. Our plans and add-ons are subscriptions. Each billing period (for example every 3 months, or every year) is paid in advance, and the subscription renews automatically at the end of each period until you cancel.
• Prices. Prices are shown in US dollars on our website and before you pay, together with how often you are billed. A price shown "per month" for a quarterly or yearly plan is there for comparison only: you pay the full amount of the billing period in advance.
• Taxes. Where sales tax, VAT or a similar tax applies, it is added to the price at checkout.
• Payment. Payments are processed by our payment provider, Stripe. We never see or store your full card number. When you buy, you authorise us, through Stripe, to charge your payment method for the first billing period straight away and for each renewal when it is due, until you cancel.
• Add-ons. Some of our Products and Services are add-ons. An add-on needs a main plan, either a paid plan or access we have given you, and works only while you have that main plan. When your main plan ends, your add-ons stop renewing and end at the close of the period you have paid for.
• Changing your billing. Where a plan offers more than one billing period, for example quarterly and yearly, you can switch between them in your account. Any amount due for the switch is shown before you confirm and is charged straight away. Unused time on your previous billing period may be credited towards the new one, as shown at the time; it is never paid out.
• Price changes. We may change our prices. A new price applies to your subscription from your first renewal after we have told you about it by email or in the app, so you have time to cancel before it applies if you wish.
• Discounts and promotion codes apply only as described when they are offered. They have no cash value and we may withdraw them at any time.
• Failed payments. If a renewal payment fails, it is tried again and we email you so you can update your card. You keep your access for a short grace period. If the payment still cannot be collected, the subscription is cancelled and your access to it ends.

5. Cancelling

You can cancel a plan or add-on at any time in your account (Account, then Plans, then Manage billing). Cancelling stops future renewals. You keep your access until the end of the billing period you have already paid for, and then it ends.

Cancelling does not give you a refund or credit for the rest of the current period (see section 6). Not using the Products and Services, or deleting our app from your phone, does not cancel your subscription.

6. All sales are final: no refunds

All our Products and Services are non-refundable. This covers every plan, add-on, renewal and plan change. Once a payment has been made it will not be refunded, in whole or in part, including for:

• unused time in a billing period, or cancelling partway through a period;
• not using the Products and Services or any of their features;
• forgetting to cancel before a renewal;
• switching plans;
• your account being limited, suspended or closed because you broke these Terms;
• the results of your trading, or being unhappy with them;
• changes to features, indicators, markets, data or content made as these Terms allow.

Immediate access to digital content. Our Products and Services are digital content and online services that you can use as soon as your payment goes through. By completing a purchase, you ask us to give you access straight away, and you accept that, as far as the law allows, you lose any right to withdraw from or cancel the purchase for a refund once access has been given.

Please make sure the Products and Services are right for you before you buy. If you have a question about a plan, write to us at support@autotrendsystem.com before you buy.

Chargebacks. If you think a charge is wrong, please contact us first so we can look into it. Disputing a valid charge with your bank or card company (a chargeback) breaks these Terms: we may suspend your account while the dispute is open, close it, and recover the amounts and fees owed.

Nothing in these Terms takes away any rights you have under consumer protection laws that cannot be excluded by an agreement.

7. Free access and promotions

We sometimes give free or discounted access, for example to partners, reviewers or as part of a promotion. That access is personal to you, may end on a set date, has no cash value, and we may change or end it at any time.

8. Your licence to use the Products and Services

While your plan or access lasts, and as long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable licence to use the Products and Services for your own trading and learning. We may withdraw this licence if you break these Terms.

You may not:

• copy, reverse engineer, decompile or try to work out the formulas, logic or code of our indicators, scanning tools or other Products and Services, recreate them, or use them to build a competing product;
• resell, sublicense, rent, share or give anyone else access to the Products and Services or any part of them;
• download in bulk, scrape, record, copy or pass on market data, indicator values, signals, alerts, lessons, videos or other content, except as allowed below;
• use bots, scripts or other automated tools to access the Products and Services, or get around the device limit or any other limit or security measure;
• interfere with the Products and Services, overload them, or test them for weaknesses;
• use the Products and Services to sell trading signals, advice, a signal group or account management to other people without our written permission;
• remove or hide our names, logos or notices;
• use the Products and Services for anything unlawful, misleading or harmful to others.

Sharing your charts. You may share pictures of your own charts showing our indicators for non-commercial purposes, for example on social media, as long as you do not present our indicators as your own, do not present the picture as investment advice or a promise of results, and do not use it to promote a competing service.

9. Market data

Prices, candles, quotes and other market data in the Products and Services come from third parties, such as data vendors and exchanges, and are for your personal, non-commercial use only. You may not redistribute or resell them.

Market data can be delayed, interrupted, incomplete, corrected later or wrong. Some markets may show delayed, indicative or sample data, and the markets, symbols and history available may change. Candles and indicator values can differ from those of other platforms and brokers. Always check prices with your broker before you trade. Our Disclaimer explains more.

10. Indicators, signals and alerts

Our indicators, their colours and signals, scan results and alerts are technical analysis tools. They are calculated automatically from past and current prices, can change while a candle is still forming, and can be wrong. They are not recommendations to buy or sell anything.

Alerts and notifications (in the app, as push notifications or by email) are sent on a best-effort basis. They depend on market data, our servers, your device and browser, your internet connection, and email and notification services, so they may arrive late, more than once, or not at all. Do not rely on them as your only way to follow the markets or manage a trade.

Limits, such as the number of active alerts or the markets our scanning tools cover, depend on your plan and may change.

11. Courses and educational content

Courses, lessons, videos, examples and all other content are for education only. Examples of charts and trades are chosen to explain how the tools work and do not show typical results. We may update, add or remove lessons and courses. The content is for your personal use: you may not copy, record, share or publish it.

12. Our app and notifications

You can add our app to the Home Screen of your phone or install it on your computer from your browser. It is a web app: it runs in your browser and needs an internet connection. Push notifications work only on devices and browsers that support them and only after you allow them. You can switch them off at any time in your alert settings or in your device or browser settings.

13. Changes and availability

We work hard to keep the Products and Services available and accurate, but we do not promise that they will always be available, uninterrupted or free of errors. Maintenance, updates, problems at our providers and events outside our control can make them unavailable.

We may change, update, add or remove features, indicators, calculations, settings, markets, data providers, content and designs at any time, for example to improve the Products and Services, for technical or legal reasons, or because a provider changes its terms. If a change significantly reduces something you have paid for, we will tell you in advance where we reasonably can. If we stop offering something you pay for altogether, we stop renewing it, and you keep it until the end of the period you have paid for where possible. Changes to the Products and Services do not entitle you to a refund.

14. Affiliate program

If you join our affiliate program, the affiliate terms shown when you join also apply to you. They explain how commissions are earned and paid. Affiliates are independent: they are not our employees, agents or representatives, and they may not make promises about earnings or trading results on our behalf. We may change the affiliate program, its terms or its commission structure, or end it, at any time.

15. Our intellectual property

The Products and Services and everything in them, including the software, design, indicators and their calculations, signals, courses, videos, text, pictures, the name AutoTrend System, the names of our Products and Services and our logos, belong to us or to those who license them to us, and are protected by intellectual property laws. Apart from the licence in section 8, these Terms give you no rights to them.

If you send us ideas or suggestions, we may use them freely, without any obligation to you.

16. Your content

The drawings, chart layouts, watchlists, alerts, settings and other content you create in the Products and Services remain yours. You allow us to store, copy and process them to provide the Products and Services to you, for example to keep your charts the same on all your devices. Our Privacy Policy explains how we handle personal data. Content linked to an account may be deleted after the account is closed, so keep your own copy of anything important.

17. Suspending or closing an account

You can stop using the Products and Services at any time and cancel your subscriptions as described in section 5. To close your account, write to us at support@autotrendsystem.com.

We may limit, suspend or close your account, or end your access to all or part of the Products and Services, straight away and without a refund, if you break these Terms (for example by sharing your account, copying our indicators, misusing chargebacks or misusing the Products and Services), if the law requires it, or to protect the Products and Services, our members or us.

The parts of these Terms that by their nature should continue after your account ends, such as sections 6, 15 and 18 to 21, continue to apply.

18. Not financial advice

AutoTrend System provides charting tools and trading education. We are not a broker, dealer, investment adviser or financial planner. We do not place trades, hold money or manage accounts. Nothing in the Products and Services is financial, investment, tax or legal advice, or a recommendation to buy, sell or hold anything. You alone are responsible for your trading decisions and their results. Trading involves a substantial risk of loss. Please read our Disclaimer, which is part of these Terms.

19. No warranties

The Products and Services are provided "as is" and "as available". As far as the law allows, we give no warranties of any kind, whether express or implied, including about their accuracy, reliability, availability, quality, fitness for a particular purpose or non-infringement, or that they will meet your needs or lead to any particular result, including any trading result.

20. Limitation of liability

As far as the law allows:

• we are not liable for any trading or investment losses, lost profits, lost income, lost opportunities or lost data, or for any indirect, incidental, special, consequential or punitive damages, however they are caused and even if we were told they were possible;
• we are not liable for losses caused by errors or delays in market data, late or missed alerts or notifications, interruptions of the Products and Services, third-party services, or events outside our reasonable control;
• our total liability for all claims relating to the Products and Services is limited to the amount you paid us in the 12 months before the event that led to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law.

21. Indemnity

You agree to cover us for claims, losses and costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the Products and Services or your trading decisions.

22. Third-party services

The Products and Services rely on and link to services run by others, such as Stripe for payments, market data providers, email and push notification services, and video players. Their own terms and privacy policies apply when you use them, and we are not responsible for them.

23. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed. If we make an important change, we will tell you by email or in the app before it takes effect. If you keep using the Products and Services after a change takes effect, the new Terms apply to you. If you do not agree to them, cancel your subscription and stop using the Products and Services.

24. Solving problems

If you have a problem with our Products and Services or a charge, please contact us first at support@autotrendsystem.com. Most problems can be solved quickly this way. You agree to try to settle any disagreement with us informally first, by writing to us and giving us at least 30 days to answer, before you start any formal claim.

25. General

• These Terms, together with the Privacy Policy, the Disclaimer and any terms shown when you buy or join the affiliate program, are the whole agreement between you and us about the Products and Services.
• If any part of these Terms is found to be invalid or unenforceable, the rest stays in force.
• If we do not enforce a right straight away, we have not given it up.
• You may not transfer your account or your rights under these Terms. We may transfer ours, for example if our business is reorganised or sold.
• We are not responsible for delays or failures caused by events outside our reasonable control, such as outages of the internet, our hosting or data providers, market closures or halts, natural disasters or government action.
• We may send you notices by email to the address on your account or show them in the app.
• These Terms are written in English. If we provide a translation, the English version applies.
